Ärende: Brewing Alcohol, legally
================================
Hello Roy,

>LL>It is legal to distill your own liquor, and drink it yourself.
>LL>No license, permit, or prescription necessary.

>RW>While true that you don't need a license to brew your own beer or
>RW>wine for your consumption, distilling alcohol requires a federal
>RW>license to do so.

>LL>Australians do not need a license.

RW>In Australia individuals may manufacture their own alcohol provided that
RW>they do not employ the use of a still. Bath-tub gin or beer comes to mind.

RW>In my experience, neither bath-tub products have the taste of the drinker
RW>in mind.

It is plainly obvious that you have never drank a bluey. :)

>LL>New Zealanders do not need a license.

RW>New Zealand lifted the ban on home distilling in 1996, and it is now legal
RW>to distill spirits for your own consumption. It is still illegal to supply
RW>or sell any alcoholic beverage without the appropriate license.

The discussion is about making your own, not selling it.

>LL>Americans should follow their fine example.

RW>In fact, the U.S. Congress passed an Act in 1978 exempting a certain
RW>amount of beer brewed for personal or family use from taxation.
RW>One of your liberal heroes, President Carter signed the Act into law.

Americans have always made their own brew, whether legal or not.
In the early days Americans were addicted to apple cider. The spicy
kind, not the stuff you buy in grocery stores. Prohibition did nothing
to stop Americans from brewing their own, whether it was wine, beer,
or hard liquor. Al Capone made a fortune. And so did the Kennedys.
And neither of them got busted for anything. Except Al, who got
caught not paying his taxes.

>LL>After all, America is supposed to be the land of the free, and the
>LL>home of the brave.

RW>It pays to know what the fuck you're talking about before you shoot off
RW>your big mouth. In fact, most states permit homebrewing, allowing 100
RW>gallons of beer per person over the age of 21 per household, up to a
RW>maximum of 200 gallons per year.

Only a confused little boy would make that kind of a comment. Since
there is no license to brew your own beer or wine, there is no maximum.
Kits are available, the only limitation being the size of the keg or
number of kegs.

RW>Because alcohol is taxed by the federal government via excise taxes,
RW>homebrewers are restricted from selling any beer they brew.

The discussion is aobut making your own, not selling it.

RW>In case the word 'restricted' goes beyond your understanding, it means
RW>that homebrewers cannot sell what they brew.

There is no restriction as to the amount one may brew.

RW>This similarly applies in most Western countries.

You are an expert on the legality of home brewing in all Western
countries? I don't think so. Of course, I am no expert either.
But at least I don't pretend to be.

>LL>It is only the sale of tobacco and alcohol that is regulated.
>LL>Not the consumption or use of such products.

>RW>One could say that the consumption of alcohol is regulated, since
>RW>you may may not drive with a certain amount of alcohol in the blood.

>LL>I might not be able to drive with a certain amount of alcohol in my
>LL>blood, but I can damn well try!

RW>I hope you give it a good go, and there's a alcohol check point in your
RW>neighborhood.

There are no alcohol check points on private property.

RW>If you're lucky, you'll have Wayne as your cell-mate.

Who is Wayne?

>RW>Doing so is considered 'driving under the influence' of a controlled
>RW>substance.

>LL>Alcohol is far from being a "controlled substance."

RW>LOL! See above where it says; Know what you're talking about before you
RW>open your big mouth.

The term "controlled substance" is a reference to illegal drugs.
Alcohol is not an illegal drug.

>LL>In any event, there is nothing illegal about driving while drunk.

RW>"know what the fuck you're talking about before you open your big mouth."

It is perfectly legal to drive drunk. It just depends where.

>RW>Not to mention that one can also be arrested for being 'drunk in
>RW>public' (you stumbling down the street for instance).

>LL>Kit Shaleen never got arrested for riding a drunk horse.
>LL>Nor did Kit ever get arrested for being "drunk in public."
>LL>Don't believe me? Just ask Cat Ballou. Or Kit's brother.
>LL>The fact of the matter is that I have every right to drive
>LL>a drunk car. Same as Kit Shaleen had every right to ride
>LL>a drunk horse.

RW>Have another one on me, you drunken bastard.

Thanks for the horse. Now if only I can find him a drink...
