Whatever that agency has the authority to enforce the Patriot Act.

Nobody knows because whoever is ordered to hand over the date, is also be
ordered to not tell anyone about it.

No. ANY server - commercial or otherwise - based in Europe that is owned by a
company with a registration in the US.

The Patriot act overrides that....

Like I said, Microsoft has already admitted that they can not prevent the US
from obtaining access to data stored on their cloud servers, even if those
servers are located outside the US.

Which was a reason for the British government to not engage in Microsoft's
cloud service.

There are EU privacy regulations that are binding to all EU countries. These
regulations require cloud operators to ensure that data about EU citizens do
not fall in the hands of foreign countries.

That EU regulation conflicts with the US Patriot Act.
