Hello Robert,

On Tuesday March 27 2012 15:56, you wrote to Ward Dossche:

MV>>> When a foreigner kills US citizens on US soil, he is tried by a
MV>>> US court. The US people would never accept anything else. So why
MV>>> would they expect the Afghan people to accept that this guy in
MV>>> NOT tried by an Afghan court but quickly carted off to the US?

RB> Look at it this way: do Dutch authorities extradite people for capital
RB> crimes to countries where capital punishment is the rule of the day
RB> (as in Afghanistan)? German authorities certainly don't.

1) The Netherlands does not extradite when there is a possibility for the
suspect to be convicted to death. It would be hypocritical for the US to impose
a simliar condition however, as they themselves have the death sentence.

2) Extradition does not apply, the suspect already was in the country where the
crimes were committed.

RB> Naturally, there's also the question whether there would be any such
RB> thing as a fair trial in Afghanistan under the circumstances.

Wrong question. The right question is: will there be anything like a fair trial
in the US under the circumstances? In the eyes of the relatives of the victims
of course. Given what has happened in other cases where the US quickly removed
suspects from the jurisdiction of the country where the crime occurred, I think
you will not easily convince the parents of those dead children that the way
this will roll out will in any way be "fair".

And of course those parents will hold the US as part responsible for the
disaster. Not only for not letting them have the satisfaction of the trial by
their own, but also for sending him to their country in the first place. That
man should never have been sent to Afghanistan again to begin with.

And so what we will have in the end is yet another group of people that hate
the US and who are ready for the next 9/11.

RB> They go crazy and murder people there for burning worn-out Korans...
RB> just imagine how they'd act in case of a _real_ crime. The guy would
RB> probably be lynched before he could even get to the courtroom.

This is a good illustration of why foreign relations with the US are so
problematic. It is the total lack of respect and consideration for other
cultures. To them, burning a Koran /IS/ a real crime. And a very serious one at
that.

Compare it to this:

They go berserker when a 30 year old man responds to a willing 14 year old girl
even if that girl exists ony in cyberspace. just imagine how they'd act in case
of a _real_ crime. The guy would probably be lynched before he could even get
to the courtroom.

For _you_ burning a Koran might be a trivial offence. I would agree. But I also
say that a 30 year old man having sex with an obviously _willing_ 14 year old,
is a triviality. And it is a non-offence when it did no go beyond the
intention, even more if there was no girl other than in the mind of a LEO.

For the people of the US, the intention to have sex with a willing 14 year old
virtual girl is a real crime.

For the people of Afghanstan burning a Koran is a real crime.

 WD>> Only 1 word: Cavalese.

 WD>> http://en.wikipedia.org/wiki/Cavalese_cable_car_disaster_(1998)

RB> Hardly a good comparison. The one, in Afghanistan, was intentional and
RB> the guy involved probably more than half crazy. The other was
RB> unintentional, due to disobeying orders and plain carelessness. And of
RB> course, Italy has no death penalty.

The common factor is that the US abused their power by removing the suspect
from the jurisdiction of the country where the crime occurred.

Cheers, Michiel
