I have been involved with running BBS in Australia for about 30 years, and
communicating with the sysops country wide during that time. If one of us had
been busted for message content during that time it would have spread like wild
fire.

Placing copyright infringing files on one's BBS is not the same as message
passing through ones system over which one has no control.

I don't recall hearing of any sysop being prosecuted for trafficking
copyrighted software either. I guess the Internet came before they could do
anything about BBSs and the problem went away.

None of this is a problem for me anyway as I don't run a BBS, especially one
with any file upload/download capability.
