In the USA, privacy of correspondence is derived from the Fourth Amendment
to the United States Constitution and thus restricted by the requirement
for a "reasonable expectation of privacy".

However, the requirement refers generally to both the user's expectation
that something is private and also to society's expectation that the thing
should be private.

Also, in the USA, the lack of secrecy of correspondence laws, email and/or
netmail exchanges sent over open accesss computers are subject to that
computer owner's property rights and are thus accessible to indiscriminate
computer owners/users.

Ward is probably being anal again because member states in the EU's
Council of Europe, the privacy of correspondence is guaranteed explicitly
by Article 8 of the European Convention on Human Rights.

Just as we in the USA have been told about US law, EU law does not apply
out of the jurisdiction of the EU...
