Read Sites' article titled "Open Letter to Devil Dogs of the 3.1" -
but make sure you read the entire piece.  It is quite revealing.

In the article, Sites notes that Marines had captured prisoners
the day before, leaving those prisoners in the mosque unguarded before
returning the next day.  Upon returning to the mosque, the first
question that entered Sites mind was -

"...why had these wounded men been left in the mosque?" - Kevin Sites

Sites noted that according to the military, quoting Lt. Col. Bob
Miller, "...the rules of engagement required soldiers or Marines to
determine hostile intent before using deadly force."

In reference to the Iraqi man in the mosque who was shot and killed
by a Marine, Sites wrote "Aside from breathing, I did not observe any
movement at all."

Oh.  And if you do not believe the Marine in question committed a war

Please note all four Geneva Conventions of 1949 were ratified
by the US in 1955.

I especially like Article 3, which prohibits "violence to life
and person, in particular murder of all kinds..."

Even under U.S. law, under The War Crimes Act of 1996 (18 U.S.C.
Section 2441), what the soldier did is considered a war crime.

And BTW, military personnel who mistreat prisoners can be prosecuted by
a court-martial under various provisions of the Uniform Code of Military
Justice (UCMJ, arts. 77-134).  Need the url?  Here it is -

Please pay close attention to Articles 118 and 81, which deal with
unpremeditated murder.

Naval Command Investigation Service is handling the case, and is
seriously investigating the incident.  Whether the Marine is charged
or not remains to be seen.

If tried and convicted of unpremedidated murder, I'd say the Marine in
question is looking at spending 20 years behind bars.  Or thereabouts.
Assuming he is not tried and convicted of premeditated murder.  In which
case, he'd probably be better off dead.
