Lets ignore for the moment what has happened.  If I form a private organization
within fidonet and make a judgement call that conflicts with my position as RC
I cannot default to saying that I made that call while wearing the other hat. 
I can wear any number of hats in any number of organizations but if any one
decision I make conflicts with policy then policy will always win--no question.
 So, regardless of anyone's position the only issue that should be discussed
here is whether policy was violated.  The only problem I have with all this is
that people assume that when policy is violated that it contains an "off with
their head" clause.  That is not true.  Even if someone were to go as far as
filing a policy complaint I do not believe anyone should lose their job or node
number -if- the problem can be addressed and agreed not to reoccur.  And, this
can apply to any number of scenarios.  Do I see a problem with overwriting
files?

Yes, for two reasons:

1.  Without even consulting a lawyer, I know that MVdV's copyright does not
affect my redistribution of fidonews here.  So the concern of this is a
non-issue.  That is why I do not bother to get entrenched in that debate.

2.  I do not believe in alteration of intransit content.

If someone not wearing a *C hat made that call then yes, otherwise no.  Ward
and others are asking important questions : where do *C responsibilities end
and responsibilites assumed by private organizations begin?  I just wish the
questions were addressed in a more tactful manner to result in a productive
discussion.  Though, I take the stance that private organizations within
fidonet are not needed, hence, why I and a few others have not been associated
with a "backbone" for years. For some reason, you always arrive at this
crossroad where "duties" conflict ...

Just because filegate distributes fidonews and nodediff does not mean it is the
ultimate authority over those areas.  For example, janis controls nodediff in
Z1, not because she is the filegate coordinator, but because the is the Z1C.

The better course of action, if you think about it, might have simply been to
temporarily withold distribution of the issue until the issue could be
discussed?  I know that would not lessen the arguements here but at least we
would have a somewhat irreversable delima.
