The EULA doesn't entitle you to a refund for bits and pieces. If you =
don't want to accept the license you can return the whole computer. One =
story a year of a guy that persuaded an OEM to give him a credit because = he
cost them more by complaining.
The EULA quoted is not relevant since that is the EULA for the boxed =
retail version not an OEM version.

Dell for the OS refund ( $10 vs $105 )

Dell today gave freelance programmer and sysadmin Dave Mitchell, of=20
Sheffield, UK, a refund of 47 pounds ($89) for the unused copy of =
Microsoft=20
Windows XP Home SP2 bundled with his new Dell Inspiron 640m laptop, =
Mitchell=20
says. Dell also refunded the tax, for a total of =A355.23 ($105).
The online version of the Microsoft Windows XP Home Edition EULA =
states,=20
"You agree to be bound by the terms of this EULA by installing, =
copying, or=20
otherwise using the software. If you do not agree, do not install, =
copy, or=20
use the software; you may return it to your place of purchase for a =
full=20
refund, if applicable."
The language in the version that Mitchell received was slightly =
different.=20
It read, "If you do not agree to the terms of this EULA, you may not =
use or=20
copy the software, and should promptly contact manufacturer for =
instructions=20
on return of the unused product(s) for a refund in accordance with=20
manufacturer's return policies."

Does Dell pay a licensing or other fee to Microsoft on machines they =
ship
without Windows? Does Dell's contracts with Microsoft require a fee =
for
every computer sold irrespective of whether Windows is sold with the=20
machine?
