Ärende: Credit card vs. cash
============================
Replying to a message of Dale Shipp to Robert Bashe:

DS> -=> On 11-14-10 14:15, Robert Bashe <=-
DS> -=> spoke to Dale Shipp about Credit card vs. cash <=-

DS>> Thanks for that link which says exactly what I was saying. All I can
DS>> do is shake my head in disbelief that you weren't aware of the
DS>> facts.

RB>> All I can put this down to is denial of unpleasant facts.
RB>> Believe what you want and hope for the best.

DS> On the contrary, it is you and the others who are creating unpleasant
DS> facts where they do not exist.

DS> Go read the article you posted. It is full of statements that confirm
DS> my statements that access to the SWIFT data by US Government was
DS> limited and done with appropriate subpoenas.

You can believe that if you wish; I prefer to believe the worst from
governments,
and I'm seldom surprised. Please keep in mind that in the US judges,
particularly
federal judges, are basically human rubber stamps and will issue a warrant or
subpoena
on any request for one.

DS> For example, from your article:
DS>
DS> The SWIFT network has been used for several years by the US Treasury
DS> Department under the TFTP to identify, locate and track down people
DS> suspected of terrorism as well as their financial backers, in the
DS> wake of the attacks of 11 September 2001. SWIFT has provided the
DS> Treasury with targeted data to trace the movements of
DS> terrorism-related funds.
Of course, the US government defines who is a terrorist and who isn't. They do
the same things in their Holy War on (some) Drugs.

DS> Certainly does not sound like the broad full scale access to spy on
DS> all EU people that you guys have been harping about.

DS> Nor does this:
DS>
DS> The Commission then mandated former counter-terrorism judge Jean-Louis
DS> BruguiŠre to produce a report in February 2009, which concluded that
DS> the United States had given guarantees on the protection of personal
DS> data.
Which guarantees aren't even worth the paper they're printed on.

DS> Nor does this quote from the article that Ward posted a link to:
DS>
DS> SWIFT's response was almost immediate. It released a statement on
DS> compliance stating that:

DS> "SWIFT takes its role as a key infrastructure of the international
DS> financial system very seriously and cooperates with authorities to
DS> prevent illegal uses of the international financial system. Where
DS> required, SWIFT has to comply with valid subpoenas.

DS> In the aftermath of the September 11th attacks, SWIFT responded to
DS> compulsory subpoenas for limited sets of data from the Office of
DS> Foreign Assets Control of the United States Department of the
DS> Treasury. Our fundamental principle has been to preserve the
DS> confidentiality of our users' data while complying with the lawful
DS> obligations in countries where we operate. Striking that balance has
DS> guided SWIFT through this process with the United States Department
DS> of the Treasury.

Note that subpoenas issued by US offices such as DOT are NOT issued by
judges, they are issued by 'administrative law judges,' who are administration
branch flunkies whose job is to give the government whatever it wants.

DS> SWIFT negotiated with the U.S. Treasury over the scope and oversight
DS> of the subpoenas. Through this process, SWIFT received significant
DS> protections and assurances as to the purpose, confidentiality,
DS> oversight and control of the limited sets of data produced under the
DS> subpoenas. Independent audit controls provide additional assurance
DS> that these protections are fully complied with."
As I said, you can believe whatever you wish. IMO what you've posted is
simply self-serving propaganda from SWIFT and the US government.
